Driving while Impaired (DWI)

Under North Carolina DWI law, one can be Driving While Impaired after consuming alcohol, taking drugs, or even from prescription medications. North Carolina DWI law requires an "appreciable impairment” while driving a motor vehicle. The basis for conviction does not necessarily depend on a particular blood alcohol level. Thus, it is possible to be convicted of DWI even if your Intoxilyzer reading is less than .08%.

North Carolina may charge you with a felony if you caused an accident or have multiple convictions on your record, under the states habitual offender law.
